The general terms and conditions of business and delivery apply.

The following general terms and conditions apply to all deliveries, services and offers. Deviating conditions of the customer, which we do not expressly acknowledge in writing, are not binding for us, even if we do not expressly contradict them.

Guarantee

In addition to the statutory provisions, the following conditions apply to the warranty:

If the product is defective, you can request the removal of the defect or the delivery of defective goods (supplementary performance). We may refuse the type of supplementary performance you have chosen if it is only possible at disproportionately high costs. In this case, your claim is limited to the other type of supplementary performance. We are also allowed to refuse this because of disproportionately high costs. If we deliver a defect-free product for the purpose of supplementary performance, you must return the defective product and pay compensation for the previous use. If the supplementary performance has failed or we have refused both types of supplementary performance, you can withdraw from the contract or reduce the purchase price. If you decide to withdraw from the contract, you will receive the purchase price back in return, taking into account the compensation for the previous use of the defective goods. Please understand that we can only accept asserted warranty claims if you can prove to us, for example by submitting the payment receipt, when you purchased the item from us. We cannot accept any liability for damage caused by improper use and treatment of the purchased item. If the goods are ready for dispatch and the dispatch or acceptance is delayed for reasons for which we are not responsible, the risk is transferred to the customer upon receipt of the notification of readiness for dispatch.

Note on tolerance and color differences at Graffi-ti.

The bits are made by hand, so there may be slight tolerances in terms of dimensions. Since it is a natural product, the Graffi-ti bits can develop different colors.

Retention of title

All delivered goods remain our property until all claims have been met, in particular the respective balance claims to which we are entitled, regardless of the legal reason. This also applies if payments are made on specially designated claims. The extended retention of title is deemed to have been agreed.

Place of performance / place of jurisdiction

The law of the Federal Republic of Germany applies to these terms and conditions and the entire legal relationship between buyer and seller. The place of fulfillment and place of jurisdiction for disputes arising from this contract is the Meldorf District Court.

Final provisions

Should a provision in these terms and conditions or a condition in the context of other agreements be or become ineffective, the validity of all other provisions or agreements will not be affected. No further agreements, changes or ancillary agreements have been made; verbal commitments must be confirmed in writing.
